1. Agreement to Terms

By accessing or using Matcha Notify ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

To use Matcha Notify and join our Discord server, you must meet the following requirements:

2.1 Age Requirements

• Minimum Age: You must be at least 13 years old to use the Service
• Parental Consent: If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian to use the Service
• Discord Terms: You must also meet Discord's Terms of Service requirements

2.2 Account Requirements

• You must have a valid Discord account in good standing
• You must provide accurate information during registration
• You are responsible for maintaining the security of your account

3. Description of Service

Matcha Notify provides automated Discord notifications when premium Japanese matcha products restock on authorized retailer websites. The Service monitors product availability and sends alerts to subscribers via Discord.

4. Subscription and Payment

4.1 Pricing

• Lifetime access: $19.99 USD (one-time payment)
• Payment is processed through Whop, our payment partner

4.2 Payment Terms

• All payments are processed securely through Whop
• Prices are subject to change with notice to existing subscribers
• You are responsible for any taxes applicable to your purchase

5. Service Delivery

5.1 Monitoring

• We monitor 25+ premium matcha brands from authorized distributors
• Monitoring is performed 24/7 using automated systems
• We make no guarantees about restock frequency or product availability

5.2 Notifications

• Alerts are delivered via Discord
• You must have a Discord account to receive notifications
• We are not responsible for Discord service interruptions

5.3 No Purchase Guarantee

• Matcha Notify provides notification services only
• We do not guarantee you will be able to purchase products
• We are not responsible for third-party retailer policies, stock levels, or purchasing processes

6. User Responsibilities

You agree to:

• Provide accurate information when subscribing
• Maintain the confidentiality of your account credentials
• Use the Service for personal, non-commercial purposes only
• Not attempt to reverse engineer, hack, or abuse the Service
• Not resell or redistribute notifications received through the Service

7. Discord Server Community Rules

7.1 Third-Party Service

• Discord is a third-party service not owned or operated by Matcha Notify
• You must comply with Discord's Terms of Service and Community Guidelines
• We are not responsible for Discord's service availability or policies

7.2 Server Access

• You will be granted access to our Discord server upon subscription
• We reserve the right to remove users who violate our community guidelines
• Access to the Discord server is contingent on active subscription status

7.3 Community Conduct

To maintain a positive community environment, the following behaviors are PROHIBITED:

• Be respectful and courteous to all community members
• Follow moderator instructions promptly
• Report rule violations to moderators via DM
• Use appropriate channels for different topics
• Keep conversations constructive and helpful

8. Enforcement and Moderation

8.1 Moderation

Our moderation team reserves the right to:

• Issue warnings for minor violations
• Temporarily mute users for repeated violations
• Remove messages that violate community rules
• Kick or ban users for serious or repeated violations

8.2 Violation Consequences

8.3 Serious Violations (Immediate Ban)

The following violations result in immediate permanent ban without refund:

• Hate speech, racism, or discrimination
• Threats of violence or self-harm
• Sharing illegal content
• Doxxing or sharing personal information
• Attempting to scam or defraud members
• Multiple account creation to evade bans

8.4 Appeals

• You may appeal a ban by contacting us via our Whop support chat
• Appeals are reviewed within 5 business days
• Decisions are final and at our sole discretion

9. Intellectual Property

9.1 Ownership

• All content, features, and functionality of the Service are owned by Matcha Notify
• Brand names and logos mentioned belong to their respective owners
• We do not claim ownership of third-party brand trademarks

9.2 Limited License

• We grant you a limited, non-exclusive, non-transferable license to use the Service for personal use
• You may not reproduce, distribute, or create derivative works from the Service

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy, reliability, or timeliness of notifications
• Uninterrupted or error-free service
• Product availability at monitored retailers
• Ability to purchase products after receiving notifications

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATCHA NOTIFY SHALL NOT BE LIABLE FOR:

• Missed restock notifications
• Inability to purchase products
• Third-party retailer actions or policies
• Discord service interruptions
• Any indirect, incidental, or consequential damages

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE ($19.99 USD).

12. Refund Policy

Please refer to our separate Refund Policy for information about refunds and cancellations.

13. Service Modifications

We reserve the right to:

• Modify or discontinue the Service at any time
• Change the list of monitored brands
• Update these Terms with notice to users
• Suspend or terminate accounts for Terms violations

14. Termination

14.1 By You

You may cancel your subscription according to our Refund Policy

14.2 By Us

• We may terminate your access for violating these Terms or community rules
• We may discontinue the Service with 30 days notice
• Termination for misconduct: No refund will be provided if you are terminated for violating these Terms

14.3 Effect of Termination

Upon termination:

• Your Discord server access will be immediately revoked
• You will no longer receive restock notifications
• Your account data will be retained according to our Privacy Policy
• Sections of these Terms that should survive termination will remain in effect

15. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
